Precious Longwe, a Zanbian woman who is alleged to have killed her husband after she shot him five times in May last year, says she acted out of intoxication that had impaired her mind to the extent that she temporarily became insane. High Court judge Sharon Newa has found Longwe with a case to answer and placed her on defence but she denied killing her husband Akakanda Liteebele.
In her defence, Longwe told the court that she engaged in a fight with her husband after a drinking spree, resulting in the shooting of Liteebele after the gun discharged accidentally.
In her submissions ahead of the judgment set for April 13, Longwe urged the court to hold that her actions were lawful because the act to discharge the gun was done accidentally as it occurred against her will during the struggle with the deceased.
She further submitted that she acted out of provocation and in self-defence as she was in eminent danger of being killed.
Longwe asked the court to acquit her or find her guilty of manslaughter because the State has failed to prove the presence of malice aforethought on her part.
She added that she acted out of intoxication that had impaired her mind to the extent that she temporarily became insane.
"On the basis of what we stated and argued above, we pray that this court adopt our submission and acquit the accused person of the offence of murder or in the alternative, we urge the court to find the accused guilty of manslaughter as the State has failed to prove the presence of malice aforethought on the part of the accused," submitted Longwe.
