A 36 year old grandmother, Bosede Oyetunde who threw away her daughter’s a-day-old boy has been sentenced to one month imprisonment by an Akure Chief Magistrate court sitting in Akure, the Ondo state capital.
According to Vanguard, Oyetunde reportedly committed the offence at about 8:00pm at Omotoso Ore road Ondo State in the Akure Magisterial District on July 4, 2017.
Although the 20-year-old mother of the boy, Opeyemi Isaac was docked alongside the accused grandmother, she was however discharged by the court.
The police prosecutor, Olayemi Ojumu said that “the accused persons conspired together to commit felony to wit murder and did unlawfully attempt to kill a day old baby boy by wrapping the child in a nylon bag and threw him into the bush”.
Ojumu said that the offence committed contravened sections 516, and 320(2) of the criminal Code Cap 37, Vol1 Laws of Ondo State of Nigeria 2006.
However the accused persons pleaded guilty to the two counts charge when it was read to them. The prosecutor narrated to the court how the accused persons were arrested by police detectives in Igbotako division.
According to him, detectives were alerted by a sympathiser who saw the grandmother when she was committing the offence and an investigation was carried out which led to the arrest of the suspects.
Ojumu who was in charge of children special center, ‘A’ Division, Akure said since the arrest of the suspects, the baby had been in the custody of the police. He told the court that the baby’s naming ceremony was even done at the police station.
The accused person who betrayed emotion said that her action was prompted by the fear on how to take care of the baby. She also told the court that her action was the work of devil.
The Chief Magistrate, Mrs O.A Edwin in her ruling sentenced the grandmother to one month imprisonment. Edwin also ordered her to render two months community service in Igbotako police station. On the the second accused person who is the mother of the baby, the Magistrate directed that she should be taken to the hospital to assess her mental state.
She observed that the mother of the baby was mentally unbalanced. The trial Magistrate also ordered that the baby should be transferred to the State Children Home and that the mother should go there to always breastfeed him.
